Crewmen who man the tugs and barges of our rivers, the Gulf of Mexico and ocean waters are vital to the commerce of America; yet, with alarming frequency, these people get hurt through no fault of their own due to the negligence of a fellow crewmember or an unseaworthy condition such as an inadequate crew, or inadequate or malfunctioning equipment. Such crewmen are usually considered Jones Act seamen and as such, when injured, are entitled to receive maintenance and cure (medical treatment) at the expense of the vessels operator until reaching maximum medical improvement. If negligence caused the injury, then such employer and / or vessel owner can also be sued for damages.
